Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PEKPIK LLM API
gateway, website and related services (the "Service"), operated by LAND4X4 PTY LTD
(ACN 637 188 222) ("we", "us", "our"). By accessing the Service, creating an account,
or using an API key, you agree to these Terms. If you are entering into these Terms on behalf of an
organisation, you represent that you have authority to bind that organisation.
1. The Service
PEKPIK LLM is an OpenAI-compatible API gateway that routes requests to multiple third-party large language model and media providers ("Upstream Providers") through a single endpoint. We provide routing, load-balancing, failover and billing; we do not create or own the underlying models.
2. Accounts and API keys
- You are responsible for safeguarding your API keys and for all activity that occurs under them.
- You must provide accurate account and billing information and keep it current.
- You must notify us promptly of any unauthorised use or suspected compromise.
3. Acceptable use
You agree not to use the Service to:
- violate any applicable law, regulation, or third-party right (including IP, privacy and export-control laws);
- generate or distribute unlawful, harmful, infringing, or fraudulent content;
- attempt to reverse-engineer, resell, or sublicense the Service except as expressly permitted;
- circumvent rate limits, usage quotas, billing, or security controls;
- send content that violates the usage policies of the relevant Upstream Provider.
Your use of a given model is also subject to that Upstream Provider's own usage policies. We may suspend or terminate access for violations of this section.
4. Pricing, billing and payment
- Prices shown on the website are indicative and quoted in US dollars. Final pricing is confirmed at the time your key is provisioned.
- Paid usage is billed on a pay-as-you-go basis according to metered token or per-call consumption.
- Published "save vs official" comparisons reference upstream providers' published list prices and are provided for general guidance only; actual savings vary with usage and provider changes.
- We may change prices prospectively; changes do not apply retroactively to usage already incurred.
- Taxes (including Australian GST where applicable) are your responsibility unless stated otherwise.
5. Refunds
Unless required by law (including the Australian Consumer Law), prepaid and unused credit may be refunded, prorated, within 30 days of purchase on request. Consumed usage is non-refundable. Nothing in these Terms excludes rights you may have under the Australian Consumer Law that cannot lawfully be excluded.
6. Availability
The Service is provided on a reasonable-efforts basis. We do not guarantee uninterrupted or error-free availability, and we may perform maintenance, or modify or discontinue features, with reasonable notice where practicable. We rely on third-party Upstream Providers whose availability is outside our control.
7. Intellectual property
We retain all rights in the Service, our software and our trademarks. You retain all rights in the inputs you submit and, as between you and us, in the outputs returned to you, subject to the rights and restrictions of the relevant Upstream Provider. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
8. Data and privacy
Our handling of personal information is described in our Privacy Policy. We do not store the content of your API prompts or completions. You are responsible for ensuring you have the necessary rights and consents for any data you submit to the Service.
9. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that model outputs are accurate, reliable, or fit for any particular use; you are responsible for evaluating outputs before relying on them. Certain guarantees under the Australian Consumer Law cannot be excluded and are not affected by this section.
10. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim, or (b) AUD 100. Where the Australian Consumer Law applies and a guarantee cannot be excluded, our liability is limited, at our option, to re-supplying the service or paying the cost of re-supply.
11. Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms or applicable law.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access immediately for breach of these Terms, non-payment, suspected abuse, or where required to protect the Service or comply with law. On termination, your right to use the Service ceases; sections that by their nature should survive (including IP, disclaimers, liability, indemnity and governing law) survive.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date and, where appropriate, communicated to active customers. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
